Delivery costs

For all purchases from countries outside the European Community, any import customs charges will be borne by the recipient. Bontex has no control over import customs duties which may vary from country to country. Contact your country’s customs to check the import costs.

For each order placed on our website, lanamerino.it issues an invoice for the material shipped, sending it by e-mail to the order holder, pursuant to Article 14 of Presidential Decree 445/2000 and Legislative Decree 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after the invoice has been issued. We also inform you that any invoice issues must be requested strictly at the time of ordering. No other possibility of request will be accepted if subsequent to the order confirmation. Delivery costs for Italy depend on the weight of the products purchased and are explicitly highlighted at the time of placing the order. The payment of the goods by the Customer will be made using the method chosen at the time of the order. Nothing is due in excess of the total amount of the order. No responsibility can be attributed to lanamerino.it in the event of delay in the processing of the order or in the delivery of what has been ordered.
Unless explicitly indicated by our Customer Service, delivery is at street level. At the time of delivery of the goods by the courier, the Customer is required to check:

  • that the number of packages delivered corresponds to what was actually ordered.
  • that the packaging is intact, not damaged, nor wet or in any way altered, even in the closing materials (adhesive tape or metal strapping).

Any damage to the packaging and/or the product or the mismatch in the number of packages or indications must be immediately disputed, by placing a written RESERVATION of CONTROL on the courier’s proof of delivery. Once the courier’s document has been signed, the Customer will no longer be able to oppose any objection about the external characteristics of what has been delivered. Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in accordance with the procedures set out in this document.

Acceptance of the general terms and conditions of sale

The contract entered into between lanamerino.it and the Customer shall be deemed to have been concluded with the acceptance, even partial, of the order by lanamerino.it. Such acceptance is deemed tacit, unless otherwise communicated to the Client in any way. By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure, and that he fully accepts the general conditions of sale and payment set out below. If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his or her professional activity), once the online purchase procedure has been completed, he or she will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 206/2005 on distance sales. Any right of the Customer to compensation for damages or indemnity, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or property, caused by the non-acceptance, even partial, of an order, is excluded.

How to buy

The Customer can only purchase the products present in the electronic catalog of the site at the time of placing the order and viewable online on our site, as described in the relevant information sheets. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but may differ in color, size, accessory products shown in the figure. All prices displayed are to be considered already inclusive of VAT.

All the specifications on the site refer solely and exclusively to the information published by distributors or manufacturers and therefore lanamerino.it cannot be held responsible in any way for the incorrect content of this information. We accept no responsibility for any errors or omissions contained on the site and reserve the right to make changes to the site as soon as you read it. The availability indicated on the website is indicative and subject to change. For this reason, in some cases, the delivery of products may be delayed. Our company assumes no liability for damages resulting from delays in deliveries. We do not provide any guarantee on the information published on the site and do not accept any liability for damages resulting from the use of the same. The correct receipt of the order is confirmed by means of an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will include the Date and Time of execution of the order and a ‘Customer Order Number’, to be used in any further communication with our support team. The message shows all the data entered by the Customer, who undertakes to verify their correctness and to promptly communicate any corrections, according to the methods described in this document.

For each order placed on our site, lanamerino.it issues the relevant tax document of the product purchased, pursuant to Article 14 of Presidential Decree 445/2000 and Legislative Decree 52/2004. Any tax invoices must be requested at the same time as the order by entering the data in the appropriate fields that will then be used for the issue itself. No type of variation will be possible after the issuance of the same.

lanamerino.it reserves the right to cancel orders that are deemed unreliable without prior notice. In this circumstance, if the customer has made the payment and it is already credited, the total amount of the order will be immediately cancelled. In the event of non-acceptance of the order, we guarantee timely communication to the Customer.

Payment methods

Credit card
In the case of purchase of goods with Credit Card payment methods, the transaction can take place through Bankpass’s secure SSL Pay Pal or Gestway server. In any case, the Customer will choose his preference at the time of completing the order. At no time during the purchase procedure or for any reason lanamerino.it is able to know the information relating to the buyer’s credit card, transmitted via a secure connection directly to the website of the bank that manages the transaction. No computer archive of our site will store this data. Under no circumstances can lanamerino.it therefore be held responsible for any fraudulent and improper use of credit cards by third parties when paying for purchased products.

Advance bank transfer
In the case of payment by Advance Bank Transfer, what the Customer has ordered will be kept committed until the bank actually credits the amount due. This credit must be made within 7 working days from the date of acceptance of the order. Order processing times depend on the bank’s credit speed and are on average around 3 working days. All amounts displayed on our website are expressed in Euros, which is the reference currency. All amounts expressed in currencies other than the Euro are to be considered indicative and subject to variations due to currency exchange.

Right of Withdrawal

Pursuant to art. 5 DL 206/2005, if the customer is a consumer, has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. To exercise this right, the customer must send Lanamerino.it a communication, within 10 working days from the date of receipt of the goods, must be sent by registered letter with acknowledgement of receipt, and addressed to: Bontex s.r.l. Via Serio, 4/b 24020 Casnigo (BG) Italy – rif. lanamerino.it. The customer, at his own expense, must send the goods back within 10 days of authorization. The goods must be intact, unused, complete with all their parts and in their original packaging (envelopes and packages), kept and possibly used according to normal diligence, without any signs of wear or dirt.

The right of withdrawal is in any case subject to the following conditions:

  • the right applies to the product purchased in its entirety; It is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, attached software, etc.).
  • The purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc.); To limit damage to the original packaging, we recommend, when possible, to place it in a second box; In all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided.
  • As required by existing health and hygiene regulations, € 30.00 will be charged for reconditioning and repackaging of the product itself.
  • The shipping costs relating to the return of the goods, in accordance with the law, are borne by the customer.
  • The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer.
  • In the event of damage to the goods during transport, we will notify the customer of the incident (within 5 working days of receipt of the goods in their warehouses), to allow him to promptly file a complaint against the courier of his choice and obtain a refund of the value of the goods (if insured); In this case, the product will be made available to the customer for its return, at the same time cancelling the withdrawal request.
  • We are not responsible in any way for damage or theft/loss of goods returned with uninsured shipments.
  • Pursuant to Legislative Decree No. 185/99 – art. 5 paragraph 3c, the customer cannot exercise the right of withdrawal for contracts for the supply of goods produced that are tailor-made or clearly personalized.

Without prejudice to the costs of reconditioning and repackaging, we will refund the customer the entire amount already paid, net of the costs incurred, within 14 days of the return of the goods, by means of a refund procedure of the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the refund (IBAN CODE of the invoice holder).

The right of withdrawal is totally forfeited, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Lanamerino.it ascertained:

  • the lack of the external packaging and/or the original internal packaging.
  • the absence of integral elements of the product (accessories, cables, manuals, parts, …).
  • damage to the product for reasons other than its transport.
  • In the event of forfeiture of the right of withdrawal, we will return the purchased goods to the sender, charging the shipping costs to the sender.

In the event of a dispute, the jurisdiction lies with the Court of Bergamo.

Guarantees

All products sold on our site are covered by the manufacturer’s conventional warranty and a 24-month warranty for lack of conformity, pursuant to DL 24/02. In order to benefit from warranty assistance, the Customer must keep a copy of the order, receipt or invoice (if issued). The 24-month warranty pursuant to Legislative Decree 24/02 applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and the provisions of the attached technical documentation. This guarantee is reserved for the private consumer (natural person who purchases the goods for purposes not related to his or her professional activity, or makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, we will provide, at no cost to the Customer, to restore the conformity of the product by repair/replacement or to reduce the price, until the termination of the contract.

Replacements in the event of DOA (Dead On Arrival) are only made if expressly provided for by the manufacturer. The timing of replacement or possible repair of the product depends exclusively on the manufacturer’s policies.

If, for any reason, you are unable to return a product under warranty (repaired or replaced) to your customer, we may proceed at our discretion to refund the full amount paid or to replace it with a product of equal or superior characteristics.

No damages can be claimed Lanamerino.it for any delays in carrying out repairs or replacements.

In cases where the application of the warranties provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc.); To limit damage to the original packaging, we recommend, when possible, to place it in a second box; In all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided.

Approval

The seller declares that all the products in the catalogue and marketed comply with the standards and approved according to the regulations of the European Community. The seller is not liable in the event of any discrepancy with the standards of countries not belonging to the European Community and/or their failure to homologate the products themselves in the said countries.

Privacy

The personal data requested during the submission of the order are collected and processed in order to satisfy the express requests of the Customer and will not be transferred to third parties in any case and for any reason. lanamerino.it guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in DL 196 of 30.06.03. The data controller is Bontex s.r.l., Via Serio 4/b – 24020 – Casnigo (BG).

Applicable law

The sales contract between the Customer and lanamerino.it is intended to be concluded in Italy and governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction is exclusively that of the Court of Bergamo.
